1. Privacy Notice
Under the Personal Data Protection Act B.E. 2562 (2019), PDPA
1.1 Data controller
HelloAds (Bangkok, Thailand), operator of UpperLive, is the data controller for personal data collected through www.upperlive.com, our LINE Official Account, email and the live service. Contact us about personal data at hello@helloads.net or LINE @helloads.
1.2 What we collect, and where it comes from
- What you type in — name, shop or company, phone or LINE ID, email and the message you send through the quote form, LINE or email
- Service data — product list, prices, selling points, Q&A, live channel details and the stream key your shop provides (we never ask for platform passwords), plus post-live summaries
- Website usage — IP address, device and browser type, pages viewed and on-page events via Google Tag Manager and Google Analytics 4 (see section 2), and a short-lived server log of IPs used to block repeated form submissions (kept no longer than one hour)
- Data of the people behind our AI hosts — face, voice and written consent of each person who agreed to an AI host being made from them (see section 3), which requires explicit consent
- Live viewers — display names and comments viewers post on the platform during your shop's live. Our system reads them only to pick an answer and to summarise the live for the shop; we keep no separate viewer profiles, and the primary controllers of viewer data are the platform and the shop that owns the account
1.3 Purposes and legal bases
- Answering enquiries, quoting and contracting — contract (section 24(3)) and steps you request before a contract
- Writing scripts, rendering clips, running lives, answering comments and reporting — contract
- Invoices, receipts and accounting records — legal obligation (section 24(6))
- Security, spam and abuse prevention — legitimate interest (section 24(5))
- Website analytics — consent for non-essential cookies (section 2)
- Marketing messages — consent only, withdrawable at any time; we do not market to people who merely asked for a quote without separate consent
- Creating and using an AI host from a person's face and voice — explicit consent (section 26), given in writing beforehand
1.4 Who we share data with
Only as needed, with processors working for us under data-processing terms: web and email hosting (Hostinger), web analytics (Google), chat (LINE), AI voice and video providers for consenting presenters, and the live platforms your shop chooses (Facebook, YouTube, Shopee, Lazada, TikTok). We do not sell personal data and disclose to authorities only where the law requires.
1.5 International transfers
Some providers above store data outside Thailand (for example Singapore, the United States, the European Union). We use only providers with internationally recognised safeguards and contractual data-protection terms, in line with sections 28 and 29 of the PDPA.
1.6 Retention
- Enquiries that do not become customers — up to 12 months after the last contact
- Customer and service data — for the contract and 2 years after it ends, for audit and disputes
- Accounting and tax records — 5 years as required by law
- Web analytics — per Google Analytics 4 retention settings (at most 14 months)
- Faces and voices of consenting presenters — while consent stands; models and source files are deleted within 30 days of withdrawal unless the law requires otherwise
1.7 Your rights
Under the PDPA you may (1) access and obtain a copy of your data, (2) have it ported, (3) object to processing, (4) have it erased, (5) have processing restricted, (6) have it corrected, (7) withdraw consent at any time without affecting earlier processing, and (8) complain to the Personal Data Protection Committee. Send requests to hello@helloads.net; we reply within 30 days and may verify your identity first.
1.8 Security
The site is fully HTTPS, access to customer data is limited to the team that needs it, we never hold your platform passwords, and the live system runs on the team's own machines, not on a public server. In the event of a high-risk data breach we notify the Office of the Personal Data Protection Committee within 72 hours and affected people as the law requires.
1.9 Minors
This is a business service. We do not knowingly collect data from anyone under 20 without a guardian's consent and delete such data as soon as we learn of it.
2. Cookies and analytics
This site uses no login or shopping cookies and no advertising cookies. The cookies present are:
- Analytics cookies (Google Analytics 4 via Google Tag Manager) — visitor counts, pages viewed, time on page and clicks on contact buttons, to improve the site. Data goes to Google and may be processed outside Thailand. Used only with your consent.
- Our own browser storage — none. We store no identifiers in your browser beyond the Google cookies above.
Opt out by blocking third-party cookies in your browser or installing Google's Analytics Opt-out add-on. The site works fully with cookies off.
3. AI use and likeness consent
3.1 Four rules we never break
- Written consent first — every AI host is made from the face and voice of a person who signed explicit consent beforehand, stating scope, duration and how to withdraw. No celebrities, public figures or anyone unaware.
- Labelled as AI — every clip and live states that it is AI-generated, as each platform requires, and is never presented as a real person streaming live.
- Only facts the shop confirmed — the AI invents no claims, prices or offers; every script is approved by the shop before air.
- A human team controls every live — an operator and an admin are backstage throughout and can stop or change any line at once.
3.2 Rights of the person behind the host
A consenting person may know which brands use their AI host and may withdraw consent at any time in writing. On withdrawal we stop creating new clips immediately, delete the voice model and source files within 30 days, and give shops using that host an agreed period to switch. Clips already published on a shop's channels are governed by the agreement between the person and us.
3.3 A host made from your own staff
If a shop wants a host made from its own employee, that employee signs consent directly with us on our form (not only through the employer) and keeps the same right to withdraw as in 3.2, including after leaving the company.
3.4 What we refuse
We do not use AI to impersonate others or to produce deceptive, threatening, obscene or unlawful content. We do not live-sell products that may not be advertised or that need licences the shop lacks (for example medicines, supplements or cosmetics with claims beyond their registration, alcohol, e-cigarettes, gambling), and we may refuse or stop any script we judge risky to consumers or to the shop's account.
4. Terms of Service
4.1 Scope
UpperLive writes scripts, renders AI host clips, runs lives on the agreed schedule, answers comments from the shop-approved answer set, streams into the shop's channel and reports after each live. Scope, hours and schedule follow the quote the shop confirms. Advertising to bring viewers in is a separate HelloAds service.
4.2 The shop's responsibilities
- Provide accurate, truthful, substantiated product data, prices and claims. The shop is responsible for what it has the AI say and for compliance with consumer-protection and advertising law and with the Thai FDA or other regulators for its products.
- Hold the rights to the products, trademarks, images and content it gives us, and bear responsibility for any infringement of others' rights.
- Own the platform accounts and follow each platform's terms, provide only the stream key or live permission needed, and accept that platforms may change their AI rules.
- Review and approve scripts and clips before air; approval confirms the content.
4.3 Packages, payment and refunds
- The service is sold as packages of live hours per the quote; the price includes system operation and a backstage admin and excludes VAT.
- Payment is due before work starts as stated in the quote; package hours are used within 90 days of the first live unless agreed otherwise.
- Hours already streamed are not refundable. Unused hours are refundable when cancellation is our fault or when a platform bans AI hosts so the service cannot continue, less the cost of scripts and clips already produced.
- Script edits or new products after launch, brand-specific hosts and advertising are charged per quote.
4.4 No guarantees; limitation of liability
We do not guarantee sales, viewers or business results, nor that a platform will not restrict the shop's account. We are not liable for indirect loss, lost profit, or loss caused by platform, internet or third-party outages. Our total liability to the shop is capped at the fees paid for the package in dispute, except for our wilful misconduct or gross negligence.
4.5 Confidentiality
Product data, cost prices, promotion plans and live results are confidential. We do not disclose them or use them for other brands unless the shop agrees in writing, for example for a case study.
4.6 Cancellation and suspension
There is no long-term contract. A shop may cancel a package that has not started with 7 days' notice. We may suspend service at once if the shop gives false information, instructs the AI to say something unlawful, fails to pay, or the live risks platform penalties, and we state the reason in writing.
4.7 Force majeure
We are not liable for delay or failure caused by events beyond our control — platform outages, platform policy changes, widespread power or internet failure, natural disaster or government orders — and make up lost live hours where we can.
4.8 Governing law
These terms are governed by Thai law. Disputes are first negotiated for 30 days, then fall under the jurisdiction of the Thai courts.
5. Intellectual Property
- Scripts and clips made for the shop — the shop may use them on its live channels and media for the service period and reuse clips within its package. The AI host may not be used to create new content with other tools or by third parties.
- The AI host and the technology — face and voice models, the show system and our methods belong to HelloAds and the consenting person under their agreement.
- The shop's content — products, trademarks, images and data stay the shop's; we hold a licence only to deliver the service.
- This website — text, images, logo and code of www.upperlive.com are © HelloAds. Facebook, YouTube, Shopee, Lazada, TikTok and LINE are trademarks of their owners, named only to identify supported platforms and implying no endorsement.
6. Complaints and contact
For personal data, consent withdrawal, improper AI use or service disputes, contact HelloAds at hello@helloads.net · LINE @helloads · phone 02-038-5565. We acknowledge within 3 business days and resolve personal-data requests within 30 days. If you are not satisfied, you may complain to the Office of the Personal Data Protection Committee or the Office of the Consumer Protection Board, as applicable.
We may update this page when the law, platform rules or the service change. Material changes are announced to current customers by email or LINE in advance; the effective date of the current version is at the top of the page.
